| I post some news for those of you who are not following the case, but certainly have not forgotten Gabbo!
The trial, where the policeman luigi spaccarotella is facing the charge of murder, started on March 20th in Arezzo.
Many witnesses, called to give a statement, said to have seen the policeman staying steady, aiming at the car for at least 5 seconds, arms straight holding the gun, before shooting.
The defense of spaccarotella, in the (disgusting) attempt to avoid the charge of intended murder, tried to underline some very little contradictions in some of these statements. They also brought to the courtroom some of the spaccarotella collegues and friends (even the priest of his town), all saying how a nice kid spaccarotella is.
Gabbo's parents, following the trial in the courtroom everyday, had the chance to meet spaccarotella on the first day of the trial. However the man didn't turn to look at them, not even to say sorry.

| Just a personal note: I hope his parents will have the patience and courage to face this trails, but most important thing is that they accept the judgment of the court, we don't want to accuse this policeman of murder with content only if it is proved to be true, as a i said gabbo will be missed and that policeman missed up even if it was proved he didn't mean to, i hope this court will be very precise and even in its judgment. | |

I really don't understand the meaning of this post... If I were you I would replace "we" with "I" Be sure that Gabbo's family is accusing this policeman of intended murder and they will be disgusted if the jury comes up with a different charge. I, as almost all Lazio fans, am accusing this policeman of intended murder. Anyway... do you think that a different charge decided by the jury would mean spaccarotella is innocent? When you have some time, read about the story of Federico Aldovrandi... and how things used to work (and perhaps still do) in Italy. http://loranablog.wordpress.com/2008/02/14/italian-police-killed-federico-aldrovandi/

| The trial is getting close to the day of the sentence, which could arrive around middle of july. Spaccarotella could get up to 21 years detention, if the public accusation abd Gabbo's family thesis is proved. A few weeks ago about 3,000 people met in Ponte Milvio to remember Gabbo and ask, once again, for justice: | |

| None of us really know if it was intentional. Let justice prevail, if it was really an accident I would not want to see the man go to jail. If as stated by you it is true that the officer was pointing his gun then throw his ass straight to jail.
I just want to know the truth and I want the policeman to pay ONLY IF it was NOT accidental.

I just want to know the truth and I want the policeman to pay ONLY IF it was NOT accidental. whaaaat? So if the jury decides it was an accident, i.e. he didn't shoot to kill, you think the guy should get away with that??? Can we all go around shooting randomly? Let me explain you what's going on. Two things can happen: A) the jury says it was an accident (unintended murder, as spaccarotella lawyers claim): spaccarotella gets up to 14 years B) the jury says it was not an accident (intended murder, as Gabbo's family lawyers and public accuse claim): spaccarotella gets up to 21 years While it is true that none of us know if it was intentional, because none of us was there, it is true that several witnesses saw spaccarotella aim at Gabbo's car and shoot, arms straight. That's intended murder, in a civil society. That might not be intended murder in Italy, and I've already linked the story of Aldovrandi, for those who want to see how things used (use) to work...

Does anybody know when the judgmentday will be? The sentence could be pronounced already this saturday (tomorrow, last day of the trial, it's the day of spaccarotella's lawyers). The maximum penalty for this crime is 21 years; the prosecutor however asked 14, arguing that the 1/3 reduction is due to the fact that "spaccarotella destroyed his own family too". The prosecutor underlined the fact that 5 witnesses saw spaccarotella aiming at Gabbo's car with straight arms, repeating the gesture in the court:

| The sentence is expected to be pronounced by tomorrow. Last saturday spaccarotella's lawyers asked for the charge of unintended murder. I won't be online tomorrow. Anyway, as the sentence is pronounced you will surely find the news on the online italian newspapers that followed the case (for instance, www.repubblica.it) | |

so, when the sentence is handed down, how many processes and appeals will follow it?? or will the matter be closed??

| I don't get the law sometimes. It's either murder, or it's not. You either intend to kill the person or you don't. It's black and white.
It would be better to let the guy walk free than give him a pitiful sentence like this for a tragic crime.

| Speachless... five witnesses were not enough to prove the charge of intended murder. If this is what they call justice, then I am ashamed to belong to this country.
The prosecutor and Gabbo's parents will appeal. There is still a long way to go before this story comes to its end.
p.s. Caxi, in the sentence the judges motivated the decision by saying that spaccarotella didn't shoot with the intention to kill, but that he accepted the "risk of killing someone". So they claim it's unintended murder.

| But if you go pointing guns at people with your finger in a place to pull the trigger, then you intend to shoot and if happens to kill someone then that's tough luck. You don't scare someone by being within millimetres of killing them...
I'm not here to pass judgement really; I just think it has been a bizarre case with a bizarre sentence to match.

| Yesterday i was commentnig the Sandri Trial on Radio and my words were very clear: I am not expecting a strong judgement but i wish that the condemn could be a "flag" for the future of this nation. >Dosen't matter if 6,10 or 15 years of jail but is more important the sentence and the motivation: Voluntary omicide.
Today, after the sentence, i m frustrated because seems , seems, that we all misunderstand , that we have been confused from the media, the radios, the stadium , the all scenary around Gabriele. 6years and NON voluntary omicide...this is the sentence and this , for the judge, demonstrate that the man who shoot is not guilty for killing someone else.
I will, from now on, keep myself in silence because , maybe, too much pressure have been done around this story. I will wait for the second trial and that's it.
